Terms of Service & User Agreement

Platform: NexBook (including Thinkly AI, NEX AI 2.3 Fusion, and associated services)
1. PREAMBLE AND ACCEPTANCE OF TERMS
By accessing, browsing, or utilizing any component of the NexBook platform (hereinafter referred to as the "Service," "Platform," or "We"), including but not limited to its Artificial Intelligence tools (Thinkly AI + NEX AI 2.3 Fusion), document repositories, marketplace, or educational redirects, you (the "User") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms").
IMPORTANT NOTICE
IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST IMMEDIATELY DISCONTINUE ALL USE OF THE PLATFORM. Continued use constitutes an irrevocable acceptance of these Terms and any future modifications.
2. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
THIS SECTION IS CRITICAL. PLEASE READ CAREFULLY.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEXBOOK AND ITS AFFILIATES, FOUNDERS, AND PARTNERS EXPRESSLY DISCLAIM ALL LIABILITY FOR ANY LOSS OR DAMAGE ARISING FROM YOUR USE OF THE SERVICE.
2.1. No Liability for AI Output
NexBook shall under no circumstances be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to:
Academic Loss: Failure in exams, incorrect homework, project rejections, or loss of grades resulting from reliance on AI-generated content.
Financial Loss: Loss of profits, revenue, or business opportunities based on AI advice or course recommendations.
Legal or Personal Loss: Any legal consequences, emotional distress, or reputational harm arising from the use of generated content.
Offensive Content: The AI models are probabilistic. We are not responsible if the AI generates content that is deemed offensive, profane, abusive, discriminatory, or inappropriate. Such outputs are unintended artifacts of large language models and do not reflect the views of NexBook.
2.2. Accuracy Disclaimer
The AI models (Thinkly AI + NEX AI 2.3 Fusion) are experimental systems. NexBook makes no representations or warranties regarding the accuracy, reliability, completeness, or timeliness of any text, image, code, or data generated.
Professional Advice: The AI is NOT a substitute for professional advice (medical, legal, financial, or academic). Users must verify all information independently.
Real-Life Decisions: Reliance on any information provided by NexBook for real-life decision-making is strictly at the User's sole risk.
3. ARTIFICIAL INTELLIGENCE (AI) USAGE POLICY
3.1. Prohibited Use Cases
Users are strictly prohibited from utilizing NexBook's AI tools for:
Illegal Activities: Promoting terrorism, crime, cyber-attacks, or violation of local/international laws.
Deceptive Practices: Creating deepfakes, spreading misinformation/fake news, academic dishonesty (cheating), or impersonation.
Harmful Content: Generating hate speech, harassment, adult/NSFW content, self-harm promotion, or violence.
Copyright Infringement: Misusing copyrighted characters, logos, trademarks, or likenesses of real persons.
3.2. User Responsibility for Generated Content
Ownership & Risk: You are solely responsible for the content you generate. Any use of AI-generated images, text, or code is at your own risk.
Indemnification: You agree to indemnify, defend, and hold harmless NexBook from any claims, damages, or expenses arising from your generation or use of AI content.
3.3. Account Termination
NexBook reserves the absolute right to block, suspend, or terminate any user account without prior notice if any misuse, anomaly, or violation of these usage policies is detected.
3.4. Chatbot Disclaimer & Terms of Use
3.4.1. Nature and Limitations of the Service
The Service employs artificial intelligence (AI) language models that generate responses based on user inputs. These models are probabilistic and may produce diverse, unpredictable, and occasionally offensive, irrelevant, or inappropriate content, including profanity, derogatory language, or discussions of sensitive topics. The Service is intended strictly for entertainment, informational, or general conversational purposes only, and not for providing professional advice (e.g., legal, medical, financial, or technical).
3.4.2. User Responsibilities
You agree to use the Service solely for lawful purposes and will not intentionally generate or solicit illegal, harmful, or abusive content.
You confirm that you are at least 18 years of age (or the minimum age required in your jurisdiction) and will comply with all applicable laws while using the Service.
You are responsible for verifying any content generated by the Service and must not base critical decisions solely on its outputs.
In the event of misuse (e.g., spamming or hacking attempts), the Provider reserves the right to immediately suspend or terminate your access.
3.4.3. Specific Disclaimer of Liability for Chatbot Content
Offensive Output: Content generated by the Service (e.g., profanity, insults, or erroneous information) may be unpredictable due to the inherent nature of AI models. NexBook does not control, endorse, or assume responsibility for such content.
Waiver of Claims: You use the Service at your own risk and hereby waive any right to hold NexBook accountable for interactions with the chatbot, including any perceived insults, inaccuracies, or harmful suggestions. NexBook shall not be liable under any circumstances for content that offends, defames, or violates third-party rights.
Liability Cap: In no event shall NexBook's total liability exceed the amount paid by you for the Service, if applicable.
4. SYSTEM INTEGRITY AND RATE LIMITING
To ensure platform stability and fair usage, NexBook employs automated traffic analysis.
Spam Detection: High-frequency requests from a single IP address or user account will be categorized as "Spam" or "Abuse."
Throttling: We reserve the right to aggressively slow down (throttle) or permanently block access to IP addresses exceeding reasonable usage limits without explanation or liability.
5. THIRD-PARTY CONTENT AND REDIRECTS
5.1. Educational Resources (Class Central)
Courses displayed on NexBook are third-party references, primarily sourced from Class Central or similar aggregators.
No Ownership: NexBook does not own, create, or manage these courses.
No Liability: We maintain no responsibility for pricing errors, certification validity, data accuracy, or content quality on third-party sites. NexBook acts solely as a reference platform.
5.2. College Official Data (SS Jain Subodh P.G. College)
Links referring to Syllabus, Results, Time Tables, or Notifications are direct redirects to the official SS Jain Subodh P.G. College website.
No Hosting: NexBook does not host or manipulate this official data.
Disclaimer: We are not liable for any delays, inaccuracies, server downtime, or errors associated with the official college portal.
5.3. External Study Materials (PDFs/Notes)
Certain materials are aggregated from public sources, student contributions, or external platforms.
DMCA/Copyright Compliance: NexBook respects intellectual property rights. If you are the rightful owner of any content and wish for its removal, submit valid proof to support@nexbook.in. Upon verification, the content will be removed immediately.
6. DATA PRIVACY AND SECURITY
Sensitive Data: NexBook explicitly advises Users NOT to submit sensitive personal data (passwords, financial details, health data, government IDs) into the AI Chatbot.
Data Utilization: Interaction data may be processed for system improvement, debugging, and session persistence (history retrieval) in accordance with our Privacy Policy.
No Liability for Leakage: While we employ reasonable security measures, NexBook shall not be liable for the unauthorized access, interception, or leakage of data voluntarily submitted by the User.
7. MODIFICATIONS AND AVAILABILITY
7.1. Right to Modify
NexBook reserves the unilateral right to update, modify, or replace these Terms, Privacy Policy, or AI Rules at any time without prior notice. Continued access to the website following any changes constitutes your acceptance of the new Terms.
7.2. Service Availability
We do not guarantee that the Platform or AI services will be available at all times. Services may be terminated, paused, slowed down, or removed entirely at our discretion without liability.
8. GOVERNING LAW AND DISPUTE RESOLUTION
These terms are governed by the laws of India. Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts located in Jaipur, Rajasthan. You hereby waive any right to a jury trial or to participate in a class action lawsuit.
9. FINAL ACKNOWLEDGMENT
BY USING NEXBOOK, YOU HEREBY WAIVE ANY AND ALL CLAIMS AGAINST NEXBOOK, ITS OWNERS, DEVELOPERS, AND AFFILIATES ARISING OUT OF YOUR USE OF THE PLATFORM. YOU AGREE THAT YOU ARE SOLELY RESPONSIBLE FOR ANY LEGAL, FINANCIAL, ACADEMIC, OR PERSONAL CONSEQUENCES RESULTING FROM YOUR INTERACTION WITH OUR SERVICES.
